So what’s happening and what exactly does it mean for me?

From 6th April 2022, the Home Office has updated the Employer’s guide to right to work checks document in order to enlighten us and provide some much needed guidance on what to do next. Fear not though, as us Human Resources specialists at Streetwise HR are on hand to explain the key April updates to the right to work checks – lucky you!

My new starter has provided a Biometric Residence Card/Permit or Frontier Worker Permit - is this ok?

Nope, not anymore we’re afraid. Biometric Residence Cards/Permits and Frontier Worker Permits are no longer acceptable as proof of right to work in the UK and new employees who have these are only able to prove their right to work using the Home Office online service.

What else is new?

Support for Ukrainian Nationals - In response to the developing conflict in Ukraine, the Home Office have made it easier for Ukrainian nationals and their family members to come to the UK. This follows the Ukraine Family Scheme Visa and Homes for Ukraine Scheme, launched in March 2022, which enable Ukraine nationals to work, rent a home and access public services.

There are two ways in which Ukraine nationals gain access to the right to work in the UK, which are dependent on whether the person you are employing has a Ukrainian passport or not. Employers need to be aware of both of these processes when employing Ukraine nationals.

It’s important to note, Ukrainians already in the UK with a visa will be able to extend their stay by extending their visa or switching to another immigration route, where eligible, even if their visa does not normally allow them to do so.

COVID-19 temporary adjusted right to work checks – Sorry, we’re still banging on about COVID-19! The end date to the adjusted right to work checks has been deferred to 30 September 2022. This gives employers more time to implement long-term, post-pandemic practices. Further information is available at Coronavirus (COVID-19): right to work checks.
